BOROUGH OF HOPEWELL NOTICE TO BIDDERS Notice is hereby given that sealed bids will be received by the Borough of Hopewell in the County of Mercer, State of New Jersey on September 12, 2013 at 11:00 a.m. prevailing time, and at that time and place publicly opened and read for the following: REVALUATION OF ALL REAL PROPERTY FOR ASSESSMENT PURPOSES IN THE BOROUGH OF HOPEWELL Bids shall be submitted on the form(s) provided, completed in accordance with the specifications contained in the Instructions to Bidders and other bidding documents, and include the following: Bid Proposal Form, with Acknowledgment of Addenda; Non-Collusion Affidavit; Bid Bond; Bidder's Ownership Disclosure Statement as required by section 1 of P.L.1977, c.33 (N.J.S.A. 52:25-24.2). CITY OF BORDENTOWN ORDINANCE 2013-16 ORDINANCE AUTHORIZING SALE AND CONVEYANCE OF MUNICIPAL PROPERTY TO CONTIGUOUS PROPERTY OWNER FOR NOMINAL CONSIDERATION WHEREAS, Ocean Spray Cranberries, Inc. ("Ocean Spray") is currently the owner of Block 1601, Lot 2 upon which Spring Street Park is located to the Southwest of Thorntown Creek which bisects the parcel; and WHEREAS, the City of Bordentown entered into an Agreement with Ocean Spray on March 20, 2013 whereby Ocean Spray agreed to convey title to Spring Street Park to the City for nominal consideration after subdivision approval was granted by the Bordentown City Planning Board to divide Spring Street Park to the Southwest of Thorntown Creek from the remaining balance of Block 1601, Lot 2 upon which Ocean Spray's distribution and warehouse facilities are located; and WHEREAS, during the course of the surveying that was required to prepare the Subdivision Plan it was discovered that the shed in the rear yard of Block 1302, Lot 1 (3 Spring Street) slightly encroaches over the lot line into Spring Street Park which creates a title impediment for both properties that can easily be rectified by a slight readjustment of the lot line that separates the two properties; and WHEREAS, the Subdivision Plan that accomplishes the foregoing, with the joinder and consent of the owner of Block 1302, Lot 1, was approved by the Planning Board pursuant to a Resolution adopted or to be adopted on September 3, 2013; and WHEREAS, N.J.S.A. 40A:12-13(b)(5) authorizes municipalities to convey municipally owned real property by private sale for a sum of not less than One Dollar ($1.00) to contiguous property owners if the municipal property being conveyed is less than an eighth of the minimum size required for development under the municipal zoning ordinance; and WHEREAS, the area of the property in Block 1601, Lot 2 involved in lot line readjustment for Block 1601, Lot 2 and Block 1302, Lot 1 to correct the shed encroachment contains only 244 square feet (0.006 acres) and is in the Commercial Industrial ("CI") zoning district which requires a minimum lot area of 43,560 square feet and is therefore less than an eighth of the minimum size required for development in the CI district; and WHEREAS, the City and the owner of Block 1302, Lot 1 both believe it is in their best interests to readjust the lot line between Spring Street Park and Block 1302, Lot 1 to correct the title impediment caused by the encroaching shed and, pursuant to N.J.S.A. 40A:12-13(b)(5), the City desires to convey, at private sale and for nominal consideration (i.e. $1.00), upon its receipt of title to Spring Street Park from Ocean Spray, the 244 square foot portion of Spring Street Park that arises from readjustment of the lot line to the owner of Block 1302, Lot 1 so that a lot consolidation deed can be filed merging the 244 square feet into Block 1302, Lot 1. NOW, THEREFORE, BE IT ORDAINED by the Board of Commissioners of the City of Bordentown as follows: SECTION I. Upon perfection of the Spring Street Park Subdivision Plan and the City's receipt of title to Spring Street Park from Ocean Spray, the City shall convey at private sale and for nominal consideration ($1.00) the 244 square foot portion of Spring Street Park contiguous to Block 1302, Lot 1 to the owner of Block 1302, Lot 1 to readjust the lot lines between the properties to create the shed encroachment on Block 1302, Lot 1. The Mayor and City Clerk, as may be necessary, are hereby authorized to execute the conveying deed for the 244 square foot portion of Spring Street Park at issue along with any related and ancillary documents necessary to complete the conveyance described herein. SECTION II. If any section, paragraph, subsection, clause or provision of this Ordinance shall be adjudged by a Court of competent jurisdiction to be invalid, such adjudication shall apply only to the section, paragraph, subsection, clause or provision so adjudged and the remainder of this Ordinance shall be deemed valid and effective. SECTION III. CITY OF BORDENTOWN ORDINANCE 2013-15 ORDINANCE AUTHORIZING THE EXCHANGE OF PROPERTY WITH OCEAN SPRAY CRANBERRIES, INC. WHEREAS, N.J.S.A. 40A:12-16 in the Local Lands and Buildings Law authorizes municipalities to exchange lands with private property owners to facilitate a public benefit; and WHEREAS, Ocean Spray Cranberries, Inc. ("Ocean Spray") owns property in the City of Bordentown that is shown and designated by the City's Tax Maps as Block 1601, Lot 2 which is traversed by Thorton Creek which runs in an east-west direction; and WHEREAS, Ocean Spray's warehouse and distribution operations are located to the northeast of Thorton Creek and Ocean Spray has allowed the City of Bordentown to use the property to the southwest of Thorton Creek for public use and recreational purposes; and WHEREAS, a ball field is located on the portion of Block 1601, Lot 2 to the southwest of Thorton Creek which has access to Spring Street and the property is commonly known as "Spring Street Park"; and WHEREAS, the City of Bordentown owns a 0.34-acre unimproved parcel fronting on Park Street which is shown and designated on the City's Tax Map as Block 1702, Lot 2 which is contiguous to Ocean Spray's landholdings fronting on Park Street to the west of the rail line that traverses Ocean Spray's landholdings in the City; and WHEREAS, Ocean Spray has announced its intent to close its fruit juice production operations in Bordentown City and relocate its operations to a new facility that is under construction in Pennsylvania's Lehigh Valley; and WHEREAS, upon subdivision approval of Block 1601, Lot 2 to separate the Spring Street Park parcel to the southwest of Thorton Creek from Ocean Spray's warehouse and distribution facilities located on the portion of the lot to the northeast of Thorton Creek, Ocean Spray has agreed to dedicate, deed and convey the Spring Street Park parcel to the City to allow for the continued recreational use of the property by the public in exchange for the City exchanging, conveying and deeding the City's property on Park Street that is designated on the City's Tax Map as Block 1702, Lot 2 to Ocean Spray so that Ocean Spray may increase the acreage of its landholdings fronting on Park Street to the west of the rail line; and WHEREAS, the Board of Commissioners of the City of Bordentown find and determine that it is in the best interest of the City and its residents to proceed with the foregoing exchange of lands. NOW, THEREFORE, BE IT ORDAINED by the Board of Commissioners of the City of Bordentown as follows: SECTION I. Upon the subdivision of Block 1601, Lot 2 owned by Ocean Spray to separate the Spring Street Park parcel to the southwest of Thorton Creek from Ocean Spray's warehouse and distribution facilities to the northeast of the Creek, and Ocean Spray's dedication, conveyance and deed of the Spring Street Park parcel to the City, the City agrees to exchange, deed and convey to Ocean Spray Block 1702, Lot 2 fronting on Park Street so that Ocean Spray may expand the acreage of its land fronting on Park Street situate to the west of the rail line that traverses its landholdings. The Mayor and City Clerk, as may be necessary, are hereby authorized to execute the conveyancing Deed for Block 1702, Lot 2 to Ocean Spray and any related and ancillary documents necessary to effectuate the land exchange hereinabove described. SECTION II. If any section, paragraph, subsection, clause or provision of this Ordinance shall be adjudged by a Court of competent jurisdiction to be invalid, such adjudication shall apply only to the section, paragraph, subsection, clause or provision so adjudged and the remainder of this Ordinance shall be deemed valid and effective.
