CITY OF BORDENTOWN ORDINANCE 2012-09 AN ORDINANCE AMENDING CHAPTER 116 OF THE CITY CODE ENTITLED "BOATS" TO INCREASE SAFETY MEASURES FOR THE BENEFIT OF USERS OF THE RAMP AND FLOATING DOCK WHEREAS, the City of Bordentown owns, maintains and operates a boat ramp and floating dock for the benefit and enjoyment of the residents of the City; and WHEREAS, a review of the activities at the facility has caused the City to reevaluate Chapter 116 to ensure that adequate safety measures are being addressed and can be effectively enforced. NOW, THEREFORE, BE IT ORDAINED AND ENACTED, by the Board of Commissioners of the City of Bordentown, County of Burlington, State of New Jersey that Chapter 116 of the Code of the City of Bordentown entitled "Boats" be and is hereby amended and supplemented as follows: ARTICLE I Amendments to Chapter 116 of the Code Entitled "Boats" Section § 116-2 entitled "Definitions" is amended to delete the definition of "Public Officer" and add the definition of "Beach Master" which shall read as follows: BEACH MASTER - the individual or individuals employed by the City of Bordentown to oversee the boat ramp and beach area and who shall have full powers to issue violations and enforce the provisions of this chapter. Section § 116-5 entitled "Fees; duration of permit" is amended at Paragraph B repealing and replacing said paragraph to read as follows: B. Permits will be valid for the calendar year for which they are issued. Section § 116-6 entitled "Parking; decals" is amended at Paragraph E to delete the words "Public Officer" and replace with "Beach Master" Section § 116-7 entitled "Restrictions and regulations" is amended at Paragraph A as follows: The following sentences are added to the conclusion of Paragraph 6: "No boat shall travel along the Crosswicks Creek within the City boundaries up to the light rail trestle bridge at a speed greater than six (6) miles per hour. Boats making wakes shall be subject to enforcement efforts from the City and state enforcement authorities." Section § 116-7 entitled "Restrictions and regulations" is amended at Paragraph B as follows: The following sentence is added to the end of Paragraph 3: "All individuals shall follow the orders and directions of the Beach Master as to appropriate locations." Paragraph 5 is amended to add the words "possessed or" so that the amended paragraph now reads: (5) Alcoholic beverages. No alcoholic beverages shall be possessed or consumed in the municipal parking lot, on the boat ramp or in vehicles utilizing same. Paragraph 6 is repealed and replaced in its entirety to read as: (6) No bicycles, scooters, skateboards, roller-blades or other similar devices shall be permitted in the ramp and dock area at any time. The following sentence is added to the end of Paragraph 8 "All such products shall be removed from site in appropriate and approved containers and disposed of in accordance to state law or regulations." The section is further supplemented to add new Paragraphs 11 and 12 to read as follows: (11). While in the boat ramp and dock area, all persons age twelve (12) and under shall wear a fitted and secured life vest, life jacket or Personal Flotation Device (PFD) and be in the company of a person age eighteen (18) or over who shall take full responsibility for the minor child(ren). The life vest must carry a manufacturer imprint that it is a Type I PFD (Off-shore), Type II PFD (near shore buoyancy aid) or Type III PFD (flotation aid). (12) All individuals shall follow the instructions, orders and directions of the Beach Master and all signs providing rules and regulation or directions for the safe use and operation of the ramp and surrounding areas. Section 116-9(B) is amended to remove the term "Public Officer" and replace the same with "Beach Master" ARTICLE II All Ordinances and provisions thereof inconsistent with the provisions of this Ordinance shall be and are hereby repealed to the extent of their inconsistency. ARTICLE III If any section, subsection, part, clause or phrase shall be declared invalid by judgment of any court of competent jurisdiction, such section, subsection, part, clause or phrase shall be deemed to be severable from the remainder of this Ordinance. ARTICLE IV This Ordinance shall take effect immediately after final passage and publication according to law. ********** NOTICE OF PENDING ORDINANCE The Ordinance published herewith was introduced and passed upon first reading at a meeting of the Board of Commissioners of the City of Bordentown, in the County of Burlington, New Jersey, held on June 11, 2012. It will be further considered for final passage after a public hearing thereon, at a meeting of said Board of Commissioners to be held at Carslake Community Center, in said City of Bordentown, on July 9, 2012 at 7:00 PM and during the week prior to and up to and including the date of such meeting, copies of said ordinance will be made available at the Clerk's Office in said City Hall to the members of the general public who shall request the same.
